For Post Power to have the ability to edit your videos we require all footage to be sent over a cloud service such as Google Drive, One Drive or We Transfer. It is the clients obligation to ensure all footage being used is licenced for use and to be altered as required, no copyright must be held over the footage by another party. Any copyright claims will be directed back to the source who provided the footage.

The client will be asked a brief for the project, once a brief has been submitted the video will go into post production, you can not make changes after this point unless both parties have agreed to them. We require all details and requirements to be submitted to Post Power via email or the Post Power official discord.

 

All footage will be stored on Google Drive; this is a external storage facility ran by a third party company should any data provided to Post Power become damaged or inaccessible Post Power can not be held responsible. Please adhere to Google Drives own security policy and procedures.

All Google Drive data is stored at the clients own risk and can be removed by Post Power at any time. Sharing of the Google Drive link is prohibited and users found sharing without permission will have there access revoked followed by instant deactivation of the folder and removal of the contents within. Your final product will only remain on google drive for up to 30 days, it may be removed afterwards so you will need to download your final project.

Footage will only be held locally on the editors computer whilst the project is being edited, it will be removed up to 30 days after the project has been completed.

Video Editing Custom Order Videos

Once Post Power has completed the initial edit of your video, you will be provided with a lower quality version of your project with a Post Power watermark. We allow unlimited changes to make sure your project is what you have requested. We don't charge for rendering time, but please note graphic intensive project will take longer to export which may lead to extended waiting times between exports. We will always ensure we hit deadlines on time.

Once the invoice has been paid in full, your video will be released at it's full HD quality.

Prohibited Content

1. The use of illegal drugs
2. Dangerous services and products
3. Adult Content (Pornography) 
4. Counterfeit goods or services that enable dishonest behaviour
5. Promotion of hate and violence
6. Gambling
7. Guns and other weapons

Transmitting any viruses or worms or code of destructive nature or any breach of Post Power terms and conditions will result in immediate termination of your Services.

Payments

All our payments are controlled by WIX Payments and PayPal. (Please refer to their policy and procedures)

Post Power at anytime may change the fees for using our website and services. Our subscription and flat fees will be posted to our website, at our sole discretion, at anytime Post Power may change these fees with a 5 working days notice. By continuing to use our services, you agree to the change of fees and will be charged accordingly.

Your subscription will automatically renew at the end of  each subscription period, unless you cancel your subscription before the end of the then-current subscription period. 

You agree to pay all fees associated with your subscription or custom order and until your account is terminated or expires, you will remain responsible for the subscription and custom order payments, even if you not use our service.

Cooperation 

The client shall co-operate with Post Power when using our services. Co-operation shall include, but not limited to: Responding promptly and properly to any correspondence, request, query or communication from Post Power.

Promptly provide information, documentation, instruction, support or any other assistance as Post Power reasonably requires. Promptly making space, resources or facilities available as may reasonably be required by Post Power. The client must also pay any and all sums due on time.

Any unlimited plans enables the Client the submission of unlimited number of projects, we will start working on each task individually in the order we receive them. Once a project is marked as complete we will then start on working on the following project.  We will not continue to deliver work or enable submission of any new projects if your subscription has been cancelled, ended, terminated or refused by Post Power.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Post Power are not obliged to edit, check or guarantee the correctness and quality of any content in any way whatsoever, and the end product shall be made at the entire risk of the Client. You (the Client) have full responsibility to check the quality and correctness of any content or final product.

Post Power are not responsible for any content or products that you publish or use on any medium or platform, it is your responsibility to check the content or products that you publish or use on any medium at any time. It is your responsibility to use any content or products that we provide you in accordance to the laws in your jurisdiction (including but not limited to copyright laws). It is your responsibility to check and ensure that any content or products that you use or publish do not infringe upon or violate any intellectual property rights or copyrights. We shall have no liability whatsoever arising from or relating to your publishing or use of any content, products or services.

Your personal information is governed by our privacy policy.

Governing Law & Jurisdiction

These Terms & Conditions can be governed by and construed in accordance with English law and the courts of England and Wales will have the exclusive jurisdiction in relation to them. 

Content Rights
 

By providing Content to Us, you grant to Us, the Service Provider, a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use that Content (including to reproduce, distribute, modify, display and perform it) for the purpose of providing the Services, operating, promoting, and improving the Services.

You (The Client) agree to and grant us (the Service Provider) the right to  publish, share , advertise and display any content, material, tasks, projects or any delivered work from us (the Service Provider) that we develop in connection with the Services provided to you, on any medium including but not limited to, our websites, portfolio, Email marketing, use case documents, educational documents or any other medium, and for any purpose, included but not limited to, marketing, advertising, use cases and PR efforts.

Sub-Contactors

The Service Provider can, at its absolute discretion, choose to retain or instruct sub-contractors to carry out the Services in whole or part.

 

Disclaimer of warranties; limitation of liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
 

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
 

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
 

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In the event that the Client or their servants or agents breach these Terms and Conditions, or are negligent in their actions, the Client will, to the fullest extent permitted by law, indemnify the Service Provider against any liability, loss, claim, damage, expense suffered by the Service Provider as a result.

Circumstances beyond the control of the parties
 

The Service Provider shall not be liable for any delay or failure to perform any term or part of these Terms and Conditions due to circumstances beyond the reasonable control of the Service Provider. Such circumstances include – but are not limited to – industrial action, lock out, trade dispute, power failure, internet outage, fire, natural disaster or outbreak of war.

As soon as is reasonably possible after the discovery of such circumstances, the Service Provider will notify the Client in writing of any anticipated or existing delay or failure in performance.

If the circumstances referred to in this clause continue for a period of longer than 1 days, the Service Provider can end the contract by giving 1 days’ notice in writing to the Client. All money owing under these Terms and Conditions before the circumstances arose shall be paid immediately.
